1) Who we are

CoachSays is operated by CoachSays (“CoachSays”, “we”, “us”, “our”).

2) The Services

CoachSays provides a messaging-based coaching experience. You communicate with the Service through third-party messaging platforms. The Service may use automated systems to generate responses based on your messages, stored conversation context, and (if you connect a fitness account) authorized fitness data.

3) Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian.

4) Accounts and access

• Your account is typically linked to your phone number (or other identifier used in the messaging platform).

• You are responsible for maintaining the confidentiality and security of your device and messaging account.

• You agree to provide accurate information in your interactions with the Service.

5) Connected fitness accounts

If you connect a third-party fitness tracking account:

• You authorize us to access the data you approve via that third party’s authorization flow.

• You can revoke access at any time via the third party’s settings.

• When access is revoked, we stop fetching new data; previously stored data may remain unless you request deletion (subject to legal/security needs).

6) Messages, delivery, and availability

• Message delivery depends on third-party messaging platforms and communications providers. Delays, failed delivery, duplication, or formatting limits can occur.

• The Service may split or shorten messages to fit platform constraints.

• We do not guarantee uninterrupted availability of the Service.

7) Health, safety, and not medical advice

CoachSays provides general information and coaching support. It is not medical advice and is not a substitute for professional medical guidance.

• Consult a qualified professional before starting or changing training, nutrition, or health routines.

• Stop exercising and seek medical advice if you experience pain, dizziness, or other concerning symptoms.

• Do not use the Service for emergencies. If you have an emergency, contact local emergency services.

You use the Service at your own risk.

8) Your content

“User Content” means messages and other information you provide through the Service (including anything you paste into chat).

• You retain ownership of your User Content.

• You grant us a worldwide, non-exclusive, royalty-free license to store, process, and use your User Content solely to provide, maintain, secure, and improve the Service.

If you share personal details (including your name), you understand that information becomes part of your stored chat history.

9) Acceptable use

You agree not to:

• Use the Service for unlawful, harmful, or abusive purposes.

• Harass, threaten, or exploit others.

• Attempt to reverse engineer, interfere with, disrupt, or overload the Service.

• Bypass rate limits or access controls.

• Upload or transmit malware or harmful code.

• Use the Service to infringe intellectual property rights.

We may suspend or terminate access if we believe you are violating these Terms or creating risk to others or to the Service.

10) Our intellectual property

The Service (including its software, branding, and response templates) is owned by or licensed to CoachSays and is protected by applicable laws. You may not copy, modify, distribute, sell, or lease any part of the Service except as allowed by these Terms.

11) Third-party services

The Service relies on third-party messaging platforms, communications providers, and (if you connect one) fitness platforms. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services outside our control.

12) Privacy

Our Privacy Policy explains what information we collect and how we use it. By using the Service, you acknowledge that we will handle personal information as described in the Privacy Policy.

13) Fees (if applicable)

If we offer paid features now or in the future, we will clearly disclose pricing and payment terms before you are charged. Taxes may apply. Subscription features (if any) may renew until canceled as described at purchase.

14) Disclaimers

To the maximum extent permitted by law:

• The Service is provided “as is” and “as available.”

• We do not guarantee accuracy, completeness, fitness outcomes, or that the Service will meet your requirements.

• Any reliance on coaching suggestions or summaries is at your discretion and risk

15) Limitation of liability

To the maximum extent permitted by law, CoachSays will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service.

Where liability cannot be excluded, our liability will be limited to the minimum amount permitted by law.

16) Indemnity

You agree to indemnify and hold harmless CoachSays from claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

17) Termination

You may stop using the Service at any time. We may suspend or terminate your access:

• if you violate these Terms,

• if required by law,

• or to protect the Service, users, or third parties.

18) Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the effective date. Continued use after changes become effective means you accept the revised Terms.

19) Governing law

These Terms are governed by the laws of South Africa, without regard to conflict of law principles. Courts located in [Province/City] will have jurisdiction, unless applicable law requires otherwise.
